Sunwater commits to full remediation for inadvertent underpayment of employee entitlements

Sunwater has apologised after a review identified that some employees on Individual Employment Contracts (IECs), who are largely technical specialists and senior leaders, are also covered under Sunwater’s Enterprise Agreement (EA).

As a result, Sunwater may have inadvertently underpaid some past and present employees employed under an IEC. Sunwater is working to identify all individuals who may not have received their full payments due under the EA during their employment.

This issue only affects past and present employees on an IEC. The bulk of our current employees including operator maintainers, electricians, mechanical trades, administration and civil teams, are not impacted. 

This is not a payroll issue and we do not believe any overpayments were made. All affected past and present employees have been paid in accordance with their Sunwater IEC. This is an issue relating to who is covered by Sunwater’s EA.

Sunwater CEO Nicole Hollows said the company is taking full responsibility and is rectifying this issue as a matter of priority.

“We recognise how serious this issue is, and Sunwater apologises sincerely to affected employees,” Ms Hollows said.

“We will pay all affected employees their full entitlements with interest.

“Sunwater is now focused on notifying affected employees and working with them to address their individual situation,” she said.

Sunwater will assess each claim on a case-by-case basis and will work to resolve the matter as soon as possible.

“Sunwater has voluntarily reported this matter to the Fair Work Ombudsman as part of our commitment to full transparency of this issue for all employees and key stakeholders,” Ms Hollows said.
