Rights of Review

Internal Review

Pursuant to sections 52 and 60 of the Freedom of Information Act 1992 (the FOI Act), if you are dissatisfied or "aggrieved" with certain decisions of SunWater (regarding access to documents or amendment of records) you can apply to SunWater for an Internal Review of its decision.

To apply for an Internal Review of a decision you must write a letter or lodge an Internal Review application form within twenty-eight (28) days of being given the decision. All Internal Review applications must be addressed to:

SunWater will undertake its Internal Review and advise you of its decision within fourteen (14) days of receipt of your application or letter.

External Review

If, after an Internal Review has been completed, you are still dissatisfied with SunWater's decision, you can request an investigation and review by the Information Commissioner. The Information Commissioner is empowered to investigate the conduct of any person or body in relation to a decision made by any department or agency under the FOI Act.

Provided you have had an Internal Review, or a decision has been made by the SunWater Principal Officer, you can apply for an external review by the Information Commissioner. You must apply to the Information Commissioner within sixty (60) days of receiving the decision from your Internal Review, or within twenty-eight (28) days where the decision is contrary to your views as a consulted third-party.

Requests to the Information Commissioner must be in writing. An application form is not required and a fee is not charged for the application or the review. Further information is available from the Office of the Information Commissioner on telephone (07) 3007 1000.
